1. Acceptance

By using PomoFish ("the App"), you agree to these Terms. If you do not agree, do not use the App.

2. Service Description

PomoFish provides two tiers of service:

Free User Features

• Setting pomodoro timers
• Daily analytics tracking
• Calendar view of fish caught
• Notifications
• Always on display functionality

Premium Features

• All features included in the Free tier
• 3x coin rewards after focus session completion
• Blocking distracting apps during active focus sessions
• Unlocked advanced analytics for weekly, monthly, yearly, and all-time views
• Access to new premium features released in future updates

The App requires access to Screen Time permissions to function properly for app blocking, and requires an active subscription to access Premium features.

3. No Account Needed

Everything is stored on your device. No sign-up, no login, no password required.

4. Subscriptions and Payments

4.1 Title, Length, and Pricing

PomoFish offers free features accessible without a subscription. Access to "PomoFish Pro" Premium features requires an active subscription or lifetime purchase. Available subscription options are:

• Monthly Subscription: $3.99 per month
• Yearly Subscription: $12.99 per year
• Lifetime Purchase: $24.99 one-time payment

Note: Prices are in USD and may vary by location and currency.

4.2 Billing and Auto-Renewal

• Payment will be charged to your iTunes / Apple ID account at the confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current billing period.
• Your account will be charged for renewal within 24-hours prior to the end of the current period, and will identify the cost of the renewal.

4.3 Management & Cancellation

• You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
• Cancellation takes effect at the end of the current billing period.
• No refunds for unused portions of a subscription period. All purchases are final unless platform refund policies apply.
• If your subscription expires, premium features will be disabled.

4.4 Free Trial

If a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription to that publication, where applicable. After the trial ends, your iTunes account will be charged the standard subscription rate.

5. Screen Time Usage

By granting Screen Time access, you acknowledge:

• The App can block apps you select.
• You can unblock apps by completing focus sessions or adjusting settings.
• We are not responsible for missed notifications from blocked apps.
• You can revoke access anytime in iOS Settings.

6. User Responsibilities

You agree to:

• Use the App in compliance with applicable laws.
• Not circumvent, bypass, or manipulate app blocking through unauthorized means.
• Not reverse engineer, decompile, or exploit bugs in the App.
• Ensure minors have parental consent before using Screen Time features.

We may restrict access if you violate these terms.

7. Age Requirements

PomoFish is rated 4+ on the App Store. Parents and guardians are responsible for minors using the App.

8. Third-Party Services

We use the following third-party services to operate the App:

• Apple: For Screen Time functionality and payment processing.
• RevenueCat: For managing subscriptions and our paywall.
• PostHog: For anonymous usage analytics to improve our App.

We respect your privacy: no data is sold, and no advertisements are displayed in the App.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted availability.
• That the App will meet your specific requirements.
• That the App will make you more productive.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Indirect, incidental, or consequential damages.
• Loss of data or productivity.
• Damages from blocked app access.

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding any claim.

11. Intellectual Property

The App, including its design, code, and content, is owned by PomoFish and protected by intellectual property laws. You may not copy, modify, or distribute the App.

12. Termination

We may terminate or suspend your access for violation of these Terms. Upon termination, your right to use the App ends immediately.

13. Changes

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated within the App.

14. Governing Law

These Terms are governed by applicable laws. Disputes shall be resolved in the competent courts.

15. App Store Terms and Standard EULA

These Terms incorporate and extend the Apple Standard End User License Agreement (EULA). By using PomoFish, you affirmatively agree to the Apple Standard EULA in addition to these specific terms. As required by Apple and Google for app distribution:

• These Terms are between you and PomoFish, not Apple or Google.
• Apple and Google are not responsible for the App or its content.
• Apple and Google have no obligation to provide maintenance or support.
• Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms.
